摘要
体育运动在我国法律体制之中走过了政策指导、法律规制、提倡保护体育权利之路,但是,作为一项基本人权,却一直没有在宪法层面得到明确的体现,这与体育运动本质属性不符;与此相对应的,虽然我国已经是体育大国,但是还不是体育强国,因此,应当结合我国相关的宪法规定,在我国宪法层面构建体育运动基本权。我国宪法第51条作为概括基本权可以承载这样的任务。
Sports in our legal system have undergone policy guidance and legal regulation. It promotes the protection of sports right, but has not been clearly reflected in the constitution as a basic human right, and not matches the essence of sport property. By contrast, although Chi- na has a ＂big gold medal＂, but also not a sports power. Therefore, we should combine with China＇s relevant provisions of the constitution, in the aspect of our constitution to construct the basic rights of sports. The 51th article of our country consittution as summarizing basic rights can carry such a task.
