Reconsideration on the Legal Nature of Sports Rights from the Perspective of Constitutional Law

摘要明晰体育权的法律性质是研究体育法的入门问题,亦能够为构建体系严密逻辑自洽的体育权保障体系奠定基础,通过对前辈学者观点的梳理,发现许多体育法学者将体育权定性为基本权利。基于此,主要采用文献资料法,从宪法学的角度分析,将体育权视为基本权利还有待商榷,既不符合基本权利的本质内涵,又超越了宪法文本的文字意涵。无论是从国际公约的角度寻找国际法依据,还是将体育权视为受教育权或文化权的一部分,都不足以证明体育权属于基本权利。在扬弃传统观点的基础上,对体育权的法律性质有了更深刻的认识,研究认为,从体育权的演变脉络和宪法文本对体育事业等相关概念的阐述来看,将体育权视为一项独立的宪法性权利较为恰当,既符合体育权发展的现状,有利于国家更精准的制定体育政策,又为今后体育权上升为基本权利预留了空间。 The purpose of the study is to clarify the legal nature of sports rights,which is the starting point for the study of sports law and provides basis for the construction of a strict,logical and harmonious system of sports rights protection. By reviewing the previous research,it is found that many sports law scholars define sports rights as basic rights,taking the attributes of sports rights as the research object. By using the method of literature and from the perspective of constitutional law,it is still open to discussion that sports rights should be defined as basic rights,which is not in line with the essence of the basic right and beyond the literal meaning of the constitutional text. Looking for the basis of the international law either from the perspective of international conventions or regarding the sports rights as part of the right to education or culture is not enough to prove that sport is a fundamental right. On the basis of sublating the traditional views,the research has discovered a deeper understanding of the legal nature of sports rights. It is found that,viewing from the evolution of sports rights and the expatiation of related concepts such as sports causes in the constitutional text,it is appropriate to regard sports rights as an independent constitutional right,which is not only in line with the current situation of the development of sports rights,but also conducive to the accurate formulation of the national sports policy and provides space for further promotion of sports rights as a basic right in the future.
