摘要
刑事审判法官对案件的判决涉及两个基本要素:事实和规范。事实的未定、事实和规范的路遇、规范的抽象性和规范载体的模糊性均使刑事司法遭遇事实的不确定、规范的不确定和语言的不确定,并由此衍生出刑事司法自由裁量权,以此实现事实的确定、规范的确定和语言的确定,最终实现罪与刑的确定。事实的确定是基础、根据和前提,事实的裁定是事实自然属性的确定,而规范的确定和语言的确定都是服务于事实法律属性的确定。因此,刑事司法自由裁量权规制不仅包括对确定事实法律属性的裁量权的规制,也包括对常被忽略的确定事实真相的裁量权的规制。基于刑事司法事实裁量权的存在领域和受制因素,可通过完善程序法制、提升实体法规范质量和严格遵循基本原则等方式来实现刑事司法事实自由裁量权规制,从而祛除影响法官事实裁量的内在和外在因素,实现刑事司法事实裁量和最终裁判的公正。
Two fundamental elements, facts and law statutes, exist in the process of a criminal decision. Uncertainty of facts, the meeting of facts and statutes, abstraction and ambiguity of language, result in three kinds of uncertainty： uncertainty of fact, uncertainty of statute, uncertainty of language, which together pro- duce judicial discretion. The ends of judicial discretion are to determine the facts, statutes and language, which bring about the determination of crime and punishment. Determination of facts is the foundation and pre- requisite of judicial decision. Discretion of facts is the determination of the its natural characteristics and the determination of statute and language serves the purpose of determining the nature of facts in law. Thus, judi- cial discretion constraint includes not only the discretion of the nature of facts in law, but also the often-over- looked discretion of facts. Based on the scope and influential factors of criminal judicial discretion, perfecting criminal procedure law, promoting the quality of substantive criminal law and applying underlying principles can restrain judicial discretion on criminal facts, and eliminate the negative internal and external elements influencing the judge to bring justice to criminal facts discretion and criminal judgment.
