摘要
关于实习大学生的法律身份和法律适用,由于立法未有明确规定,理论界出现了实习大学生是否属于劳动者以及大学生实习属于劳动关系还是劳务关系的争论。笔者从劳动者主体界定标准和劳动法立法目的的视角考察,认为符合条件的大学生实习应纳入劳动法的保护范畴。同时,借鉴德国和美国的相关制度,在具体适用上给予特殊的制度安排。
There is no clear legislative provisions about the status of the internship students. Theoretically there exist two controversies: firstly, whether internship students are laborer or not; secondly, whether college internships are labor relations or not. From the perspective of the labor standards and legislative purpose, the author believes that qualified students internship should be included in the scope of protection of labor law. Meanwhile, from Germany and the United States related systems, we should give the special institutional arrangements in practice.
