摘要
在线纠纷解决机制解决争议的主要方式也是调解和仲裁。但在线纠纷解决中,仲裁员或者调解员不参与争议的解决,有关争议通过计算机程序而自动地得以处理,可以有效地减少面对面的冲突,同时,这种方式不需要严格追究双方的责任,而能够简便地达成协议。网上调解与和解的主要优势是它们具有灵活性、简便性。这尤其有利于全球化商务活动的开展,有利于人类社会的和谐。我国要借鉴与吸收欧盟在线纠纷解决的经验,结合我国电子商务发展的实际情况,构建好我国的在线纠纷解决机制。
The main ways of online dispute resolution mechanism are mediation and arbitration. But during solving the online dispute resolution, the arbitrator or the mediator does not participate in the settlement of disputes and deal with the controversial automatically by a computer program, which can effectively reduce the face-to-face conflict, at the same time, this approach does not need strictly pursue the responsibility of both sides, and can easily reach an agreement. The main advantages of online mediation and reconciliation are flexibility and convenience, which is especially conducive to the development of global business activities and beneficial to the harmony of human society. We should draw lessons and absorb the experience of online dispute resolution, combined with the actual situation of China＇s a good online dispute resolution mechanism in our country. development, and build a good online dispute resolution mechanism in our country.
