摘要
调查统计发现,全国在土地使用权招标出让中,存在近四成的经营性用地,且成交方式多为综合评标。经营性用地采用综合评标,存在违背市场价值规律、削弱市场竞争、容易造成国有资产流失和行政腐败等问题。经营性用地招标应优先采用价高者得的成交方式,充分体现土地的市场价值。因此,需要采用综合评标的,要合理确定评标因素及评分规则,增强评标过程的保密性,确保招标的公平性和公正性。
It has been found through investigations that in nationwide bidding for land use rights there are nearly forty percent of profit-oriented land, and the way of transaction is in most cases the comprehensive evaluation, which has violated the law of market value, weakened market competition and readily led to the loss of state-owned property and the administrative corruption. Biddings for profit-oriented land should give priority to the mode of the highest bidder winning the transaction to fully reflect the market value of the land. Therefore, it is necessary to confirm reasonable assurance evaluation factors and scoring rules and enhance the confidentiality of the evaluation process so as to ensure the fairness of the bidding, in the case of comprehensive evaluation.
