摘要
就医是否消费已成为《中华人民共和国消费者权益保护法》能否适用于医患纠纷的前提性问题。作者认为 ,从经济学意义上来讲 ,就医确属消费。但从法律角度来看 ,医患法律关系与消费法律关系是两种截然不同的法律关系 ,二者在主体、内容、预期性、风险性等多个方面都有实质性差别。而消费者权益对患者也不适宜 ,因此《消费者权益保护法》不宜适用于医患纠纷。
Whether acts of seeking medical advice are acts of consumption has become an issue of presupposition for determining whether the Consumers Rights and Interests Protection Act of the PRC is appropriate for solving medical disputes. The author holds that from the perspective of economics acts of seeking medical advice are indeed acts of consumption. Yet from the legal perspective, the legal relationship between medical workers and patients and the legal relationship involved in consumption are entirely different, with substantial differences in many aspects, including the subjects, contents and the nature of anticipation and risk. Besides, the rights and interests of consumers are inappropriate for patients. Thus the Consumers Rights and Interests Protection Act is not suitable for the solution of medical disputes.
