摘要
从制度经济学的视角对现行农村宅基地产权制度进行剖析。指出现行所有权与使用权相分离的农村宅基地产权制度导致土地资源浪费,土地利用率降低及限制物权效应发挥问题,提出完善宅基地的登记和发证工作,赋予农村宅基地完整的使用权,建立宅基地自由流转和有效退出机制,形成宅基地流转的途径。
Based on new institutional economics, the rural housing land property rights were discussed in this thesis. The existed problems of sever waste of land resources; decreased land utilization rate and limited real property were pointed out. Moreover, these problems may result from the separation of land ownership and use right. Finally, suggestions about rural housing land transferences were put forward. They were improving land registration and certification work, endowing complete rural housing land use right, establishment of homestead free transfer and effective exit mechanism.
