摘要
植物是城市绿地的主体,树木管理是城市园林绿化的重要工作之一。通过分析我国现有法规关于园林树木管理的行政许可、行政处罚和刑事责任等立法内容,指出城市园林管理过程中的立法漏洞之处;讨论了关于大树和古树进城的相关法规问题,建议国家园林绿化行政主管部门及时出台《城乡树木管理办法》部门规章,牵头起草《古树名木管理条例》行政法规,并联合其他部门加强城市园林绿化苗木的市场管理等。
Plants are the main parts of urban green space, and the management of trees is one of the most important works in urban landscape greening. Through the analysis of legislation contents of existing laws and regulations of China on the administrative permission, administrative punishment, and criminal liability, it pointed out the regulation loopholes in urban landscape management process, discussed about relative laws and regulations on transplanting big trees and ancient trees in cities, proposed national landscaping competent administrative department setting out Measures on Administration of Urban and Rural Trees, and taking the lead in crafting Regulations on Administration of Old and Famous Trees, cooperating with other departments to strengthen the market management of urban landscape nursery stocks and so on.
