摘要
杀人案件动机十分复杂,有主导性动机和情景性动机之分。主导性动机在犯罪动机体系中占据着主导地位,支配、推动主要犯罪行为的实施,同时主导性动机决定着案件的性质,而情景性动机是犯罪分子在实施主要犯罪行为过程中,由于客观环境发生了变化而临时萌生的动机,它干扰了侦查人员对案件性质的准确判断,迟滞案件的侦破工作。在纷杂的犯罪动机体系中找出主导性动机是正确判断案件性质的关键,文章从被害人的角度、现场痕迹物证角度、犯罪心理痕迹角度对主导性动机分析判断方法进行梳理研究。
There are complex motivations in murder cases, which can be divided into dominant motivation and situational motivation. Dominant motivation is of the dominant status in a murder, pushing forward the im- plementation of the crime. The subjective initiative decides the nature of a case. The situational motivation means the objective environment makes a criminal change motivation in certain offense because of objective environment. It will disturb the judgment of investigators to the nature of certain case, and thus dragging on in- vestigation. It＇ s of key importance to find out dominant motivation from numerous motivations in a crime. This essay makes research on methods to analyze and judge dominant motivation, based on prospectives of victims, trace evidences in crime scene and criminal mind
