摘要
《科学技术进步法》修订实施以来,我国科技资源共享立法工作快速发展,但仍存在综合性法律法规缺失、内容缺乏可操作性及立法效果不佳等诸多问题,而世界主要发达国家和地区十分重视科技资源共享的立法保障。在我国科技资源共享立法策略方面,应当从立法宗旨、基本原则、立法模式等方面入手,不断推进我国科技资源共享立法工作的进行。
Rapid development has taken place in China＇s scientific and technological resources sharing legislation since the implementa- tion of the revised Science and Technology Progress Law. However, there still exists some problems which are needed to be solved further, such as lack of comprehensive laws and regulations, lack of operability and ineffectiveness. Legislative guarantees for technical resources sharing are highly appreciated in the world＇s major developed countries and regions. In order to promote the legislation of scientific and technological resources sharing, legislative strategy shall be attached importance to and these issues such as purpose of legislation, basic principles and legislative model shall be studied intensively.
