摘要
网络反腐是信息时代反腐的新渠道,其以低成本、高效率之优势在反腐败工作中大显神威。但我们也应看到这样的事实:一方面,由于网民自身的局限性所带来的反腐的不确定性、网络暴力甚至侵权行为层出不穷;另一方面,来自被监督者通过技术、行政、立法等手段对民间网络反腐的穷追猛堵,网络反腐面临重重困境。而目前,我国关于网络反腐的法律规制并不完善,难以解决网络反腐所面临的现实问题。因此,加强网络反腐立法,规范网络反腐行为,使网络反腐得以有序发展是我国目前所面临的重大课题。
Online anti-corruption is a new form of anti-corruption in the information era, which proves to be greatly important for its low cost and high efficiency. However, some facts related to it cannot be neglected. For one thing, uncertainties, online violence or even violation of rights frequently occur due to net citizens＇own limits. For another, many difficulties exist due to the obstacles or even attacks initiated by the authorities being monitored to websites organized by citizens. In the present age, laws on online anti-corruption are not sound as to serve as guiding principles to solve practical issues relevant to online anti-corruption. Therefore, it is of significant value to strengthen the legislation of anti-corruption law and to guide online anti-corruption behavior to ensure the healthy development of online anti-corruption.
