摘要
气候变化技术的转让对于实现温室气体减排目标具有决定性作用。但由于发达国家与发展中国家对于气候变化技术转让知识产权问题存在分歧,现行气候变化技术转让的知识产权制度仍然是建立在TRIPS协定和内国传统知识产权制度基础之上,这成为了发展中国家获得气候变化技术的重要障碍。在人类面对气候变化威胁和挑战的情况下,知识产权制度应当改革,建立起因应气候变化的国际知识产权制度。这种国际知识产权制度应当定位于气候变化技术"全球公共物品"之上,在《联合国气候变化控制框架公约》的法律体系内,建立气候变化技术转让的专门知识产权制度和配套机制。
There is a decisive role in the transfer of climate change technologies for achieving the goal of reducing greenhouse gas e- missions. However, because there are still differences between developed and developing countries for related intellectual property is- sues about the transfer of climate change technologies, the intellectual property mechanisms of transfer about climate change technolo- gies are still built on the basis of the TRIPS Agreement and the country＇s traditional intellectual property system. The mechanism essen- tially becomes a major obstacle to the access of developing countries to climate change technologies. In the ease of the threats and chal- lenges of climate change to the human, the intellectual property system should reform and the international intellectual property rights mechanism response to climate change should be set up. The mechanisms should be built on the basis of the positioning of the climate change technologies ＂global public goods＂, should be built in the legal system of The United Nations Climate Change Control Frame- work Convention, should establish a specialist intellectual property system and supporting mechanisms of transfer about elimate change technologies.
