摘要
本文借助解剖百度文库著作权侵权纠纷的例子，将批判的对象扩展到整个新经济，分析其在中国兴起的法律保障和意识形态因素，特别是新经济如何通过商业模式的创新解决合法性问题，最终确立其不可动摇的地位。本文还将分析互联网企业在这一模式下，如何使网民大众成为它们的免费劳动力，为其创造财富，并将自己牢牢捆绑在新经济庞大的机器上，逐渐失去对个人信息内容的控制，卷入一个监控更多、自由更少的世界。
This paper attempts to p omy by examining the recent copyri will discuss the critical factors such rovide a critical analysis over the new econ-infringement disputes of Baidu Wenku. It legal and ideological conditions during the rise of the Internet in China, especially how the new economy solved the problem of legitimacy by means of business model innovation and finally established itself. This paper will also analyze under such model how the Internet companies make the mass users become their free labor, create values for them, tie themselves onto the huge digital machine of the new economy, lose control over personal data, and get in- volved into a brave new world with more surveillance and less freedom.
