摘要
建立在垄断杠杆理论基础上的知识产品搭售行为,兼具剥削性滥用和妨碍性滥用之性质,其实质乃是在结卖品市场上拥有足够市场力量的知识产权厂商滥用其市场支配地位的行为。在对此种行为进行反垄断规制时,必须就结卖品和搭卖品之彼此独立性、是否产生封锁市场的反竞争效应、有无客观合理性等方面进行一一考证,以此方可提高反垄断执法的严密性和科学性。
The tying of intellectual product based on the monopoly leveraging theory combines the characters ot both exploitative abuses and obstructive abuses, whose essence reflects a kind of abuse of Intellectual Property Rights. Generally speaking, tying is a common marketing strategy. However, if the Intellectual Property Rights owner who has the market dominance abuses this position to implement a tying arrangement without good reason, it is defi- nitely prohibited by anti-monopoly law. In order to regulate this action, the regulator needs examine the independence between tying goods and tied goods, the anti-competitive effect of market blockade, the objective rationality and so forth, which could finally improve the scientificity, strictness and normality of anti-monopoly enforcement.
