On the Formation of Theoretical Framework of IP with Chinese Characteristics

摘要 "中国特色知识产权理论体系"是在知识产权问题上对"中国发展道路"的理论概括,是"中国特色社会主义理论体系"的有机组成部分。这一理论"体系"的构建将为国家知识产权政策制定提供理论指导,为建设"中国特色社会主义理论体系"提供具体学科的理论支持,为其他与我国相类似的发展中国家提供理论示范。从"是否有必要"、"是否有能力"以及"如何构建"的经验性思考和总体框架等五个方面对此问题进行探讨。 The theoretical framework of IPR with chinese characteristics, which generalizes the contemporary practices of chinese IPR-related enterprise, forms the organic component of the socialism theoretical framework with chinese characteristics. The formation of this theoretical framework, which is the concrete embodiment of the socialism theoretical framework with chinese characteristics, will provide a theoretical guideline for the IPR-policy drafting of the state, and theory guidance for other developing nations similar to China. This article, from five perspectives, such as the necessity, feasibility, viewpoint of history ＆ methodology, general framework, attempts to probe comprehensively into the issues of the formation of this framework, and keep solicited for comments.
