摘要
公务人员财产申报制度被称为"阳光法案",是国际社会公认的预防腐败的终端利器,各国均在立法中做了完善规定。当前我国的公务人员财产申报制度尚未真正确立,只限于政策性规定,没有上升到立法层面,缺乏强制性、执行力和有效监督,不能充分发挥从源头上预防腐败的应有作用。我们应适应我国当前的反腐形势,考虑将这一制度入法,并参照国外立法先进经验,确立完备的制度内容。
The system of government employee＇s declaration of property, known as the ＂sunshine act＂ is an effective anti- corruption means recognized by the international community. A lot of countries have established it in their law. The system of government employee＇s declaration of property in China is still a policy currently which hasn＇t been established in the legislation and lacks of compulsory execution and effective supervision, thus it cannot play its due role in preventing corruption. In view of current anti-corruption situation, this system should be established into legislation and contents of the system should be completed with reference to foreign advanced legislative experience.
