摘要
刑事错案是指侦查机关、检察机关、审判机关、刑罚执行机关在刑事司法活动中,错误认定客观事实,适用实体法律错误,违反程序法规的相关规定,使刑事案件的侦查、起诉、审判和执行行为或结果与应然意义上的行为或结果不相一致的刑事案件。它与冤假错案不是等同概念,应当予以厘清。
The criminal misjudged case means that the investigation organs, the procuratorial organs, the judicial organs, the penalty enforcement authorities misattrihute objective facts, apply entity law mistake, violate the relevant provisions of the procedures and regulations, which makes the criminal case investigation, prosecution, trial and exe- cution behavior or results inconsistent with criminal cases in criminal judicial activities. It, being unequal with the unjust cases concept, shall be clarified.
