摘要
劳动关系概念是构筑劳动法大厦的基石。中国理论与实务中对劳动关系概念的表述中存在着不少问题,故建议将劳动关系双方主体表述为"用工主体"和"劳动者"。从属劳动构成了劳动关系的本质特征,所以劳动关系概念应体现其本质特征。劳动关系是劳动者和用工主体之间因发生从属劳动而形成的社会关系。
The conception of labor relationship is the cornerstone of constructing the building of Labor Law. There are many questions about expressing the conception of the labor relationship in the Chinese theory and practice. Both subjects of the labor ＇relationship should be expressed＂ subject of employing the laborer＂ and ＂laborer＂ ; Subordinate labor constitutes the essential features of the labor relationship, the conception of labor relationship should reflect its essential features; The labor relationship is the social relationship caused by subordinate labor between the laborer and the subject of employing the laborer.
