摘要
伴随着市场经济体制改革的不断深化和现代企业制度的推进,我国企业民主管理无论从内容上还是形式上都在发展和提高。党的十一届三中全会后,我国的企业民主管理立法也随着改革的进程不断完备,但仍存在立法层次不高、法律规定不明确和法律责任薄弱、刚性不足等一系列问题,滞后于我国企业民主管理的实践。完善企业民主管理立法是落实党的十八大"健全以职工代表大会为基本形式的企事业单位民主管理制度"的重要举措,是我国企业民主管理实践发展的要求。因此,要提高企业民主管理的立法层次,更新法律内容,明确法律责任,逐步建立和完善企业民主管理的法律体系。
Along with the development of socialist market economy and modem enterprise system, democratic management in en- terprises of China should be improved from content to form. To improve the legislation on democratic management in enterprises is an important measure of implementing the spirit of the eighteenth National Congress of the CPC. Therefore, we should enhance the legislation level of democratic management, update contents of law, and define responsibility clearly so as to improve the legal sys- tem of democratic management in enterprises progressively.
