摘要
刘易斯·科塞的冲突功能论为提出"司法扬弃民意说"提供了研究范式。我们从民意之于司法的角度分析其功能,包括民意影响司法理性和司法公正的负功能;民意制约行政权力干预司法、为司法提供多元参考价值、增强司法裁判可接受性的正功能;进而为司法吸纳民意趋利避害提出扬弃的策略,包括对民意的甄别、民意的引导以及与民意的交流及反馈。
The conflict＇s functional theory of Lewis Coser provides a Research Paradigm for presenting the statement of the justice sublating the public opinion. Based on the point of the public opinion affecting the judicial,we analyze its＇ function. The function refers to the negative functions and the positive func- tions. The negative functions include that the public ;opinion affecting judicial independence and judicial justice. The positive functions of public opinion have the following aspects： restricting the administra- tive authority interfering in the judicial, providing multiple reference value, and enhancing the accepta- bility of judicial judgment. Through the analysis, the paper provides sublation strategies for the justice absorbing the public opinion,including screening and guiding the public opinion and the communication and feedback with the public opinion.
