摘要
民意对司法有积极作用,也有消极影响。民意与司法的关系应该是在保证司法独立的情况下,吸纳民意。吸纳民意应该以间接的方式实现,即通过完善人民陪审员制度吸纳民意,通过增强立法的透明度表达民意,而不是由公众或媒体直接给予司法压力。
Public opinion has a positive effect on judiciary, but also has a negative impact. The relationship between public opinion and judiciary is that judicial independence should be assured, but also to collect views from the public. However, the public opinion should be absorbed through indirect means by improving our people＇s jury system and the transparency of the legislative process, rather than directly to the public or media pressuring on the judiciary.
