摘要
实践中,越来越多的劳动争议案件的发生是围绕用人单位单方解除劳动合同产生的。用人单位单方解除权的滥用,一方面会威胁劳动者的生存权,另一方面也必然会影响劳动关系的稳定,甚至会影响整个社会的和谐。笔者在介绍解雇自由和解雇保护的概念及相关发展的基础上,分别从自然法、经济学、社会学角度对解雇保护的正当性进行了论述,指出我国对用人单位的单方解除权进行限制是正当的,也是符合国际立法趋势的。然后透过司法实践遇到的问题指出我国劳动合同法中解雇保护的不足和缺陷,并在参照国外成功立法的基础上,提出了完善我国用人单位单方解除劳动合同的立法建议,希望通过事前、事中、事后的全方面规制完善来形成一套完整的解雇保护制度,达到效率和公平的最佳平衡点,体现合理性。
In practice, with more and more employers terminate labor contract unilaterally, labor dispute cases arise unprecedented. Employer misusing the right of terminating labor contract will reduce two bad results. On the one hand, it will threaten the legitimate right of labor, on the other hand, it will affect the stability of labor rela- tions. What is more, it will affect the whole social harmony. Firstly, this paper introduces the concept of the free- dom on fire and the protection regulations on fire, then discuss the legitimacy of protection regulations on fire from the angle of natural law, sociology, and economics respectively, and points out in our country the law in lim- iting this right is justified, and limiting this right is also accord with the international trend of the legislation. Secondly, this paper points out the insufficient and defect in labor contract law on the protection regulations on fire after analyzing problems in judicial practices, and learn from successful legislation in foreign, put forward the legislative proposals and the labor contract legislation suggestion. The writer hopes to form a complete set of fire protection system through making rules and regulations before hand, in the process and afterwards, to achieve ef- ficiency and fairness is the best balance point, and reflect the rationality.
