摘要
劳务派遣制度自实施以来,出现了大量问题,劳务派遣用工泛滥、不规范,劳动者的合法权益得不到有效保障,同工不同酬问题较为突出,派遣协议双方存在用工隐患,严重影响劳动关系的和谐与稳定。因此,应当对劳务派遣作进一步规制。本文针对《中华人民共和国劳动合同法修正案(草案)》(以下简称劳动合同法修正案草案)拟定之劳务派遣修改,提出若干学理建议。
Since the implementation of Labor dispatch system, there are a lot of problems , such as la- bor dispatch flood and is not standardized, the legitimate rights and interests of workers can not be effectively guaranteed, rights of participating in democratic management of enterprises and trade union can not be implemented, equal pay for pact on the harmony and stabili unequal work is more prominent and so on. All of these have a serious ty of labor relations. Therefore, we should further regulation on labor lm dis patch. According to " People's Republic of China Labor Contract Law Amendment (Draft) "(Hereinafter is referred to as the labor contract law draft), which is ready to make some modification, the author puts forward some theoretical suggestions.
