摘要
村规民约古已有之,传承于古代传统乡规民约与乡约,历经了从传统到现代的创造性演化过程,成为了一种活着的传统。其现代制度价值主要是协调国家法与习惯法二者的关系。文章试图运用新的叙事方式延展村规民约的内涵,以连续性而非片段性的观察视角还原村规民约多维度、多层次、多功能的面向,为拓展其制度空间的背景和价值奠定新的基础。
The thesis attempts to use new ways of narration to expand the connotation of modem village regulations and rules and revert multi-dimension, multi-level and multi-functional directions from the observation perspective of continuity rather than fragment and tries to lay a new foundation to expand its institutional background and value.
