摘要
从我国对外贸易中遭遇外国污染转嫁的现状出发,分析了我国对外贸易中外国污染转嫁的成因,包括经济利益的驱动、我国环境标准较低、国际法存在的缺陷及我国防治污染转嫁相关法律的不完善等,并从尽快使我国的环境标准与国际接轨、进一步完善我国防治污染转嫁相关的法律及加强对外投资和引进项目的环境管理等方面论述了我国对外贸易中防止外国污染转嫁的法律对策。
From the status quo of China＇s foreign trade experiencing foreign pollution transfer, the paper analyzes the origin of foreign pollution transfer in foreign trade, including drive of economic interest, lower environmental standards in China, defects in international law and imperfect law about prevention of pollution transfer in China, etc. The legal countermeasures to prevent foreign pollution transfer in foreign trade of China are discussed from the aspects of connection of China＇s environmental standards with international practice as soon as possible, further completing relevant laws to prevent pollution transfer, as well as strengthening environmental management of foreign investment and introduction project.
