摘要
本文把中国行政指导的实践分成三个阶段进行考察 ,并从程序规范及责任、救济两个角度对目前中国行政指导面临的“合法性危机”进行了分析 ,提出 :应建构行政指导的法律规范机制对其加以必要的规制。
This essay takes into consideration the practice of China's administrative guidance and divides it into three stages. From the two aspects of procedure standardization, and responsibility and compensation, the essay makes a thorough analysis of the 'Legitimacy Crisis' that China's administrative guidance is facing at present. It finally points out that it is necessary to establish a legal system of administrative guidance standardization.
