摘要
社会越成长,行业愈成熟;同时,法治愈发展,则行业法愈发达。社会发展的这两个趋势在中国已初见端倪。本文分析了我国涉及行业的立法日益增长,但行业的法制仍然存在诸多具普遍性的难题。文章提出"行业法"概念,并论述了它在法律体系中的意义,认为行业法是跨部门法的,它具有部门法所没有的优势和作用。进而阐述了发展行业法的目标和途径,以及行业法在法学研究和教育中可作为的改革空间。
The occupations will become more mature with the development of the society, while the laws of occupation will become more sophisticated with the development of the rule of law. These two tendencies have gradually emerged in China. This article analyzes that there are still many difficult problems existing in the legal construction of occupation although the legislations of occupation in China increasing gradually in China. The article puts forward the concept of ＂occupation law＂ and discusses its significance, which is occupation law is cross-department law and has the many advantages and functions. In addition, the article further explains the purposes and paths of developing occupation law and the reform space of occupation in legal research and education.
