摘要
警察作为历史现象,其含义在不同的历史时期有不同表现。从宪法条文入手,以宪政的角度分析警察的含义有助于厘清警察的含义。从部分国家宪法文本分析警察含义表现为一种行政作用或行政行为,其目的体现为社会公共秩序的维护,公民权利的保障;其功能通过法定的强制、指导、服务方式实现,包括警察的协助行政功能。结合我国宪法文本分析,我国的警察权的性质就是行政权,且警察含义中积极行政内容增多,应对其严格控制与规范。
The meaning of police as a historical heritage,have been a lot of explanation.In general,an analysis from the provision of constitutional regulation,its common meaning of police is an administrative action or administrative power to strengthen the social public order and guarantee the civil rights;the function of police power are embodied mainly through the means of compulsory,guiding and service,in clouding administrative helper function of police.The nature of police power is an administrative power,I think,through an analysis of constitutional text in china.
