摘要
面对北极争夺的升温,首先论述了在《联合国海洋法公约》《斯瓦尔巴德条约》以及国际海事组织相关公约等现有国际法律体系及机制下,中国在北极海域所享有的国际法权利;然后从政治和法律两个角度,提出了中国参与北极事务以争取获得更多海洋法权利的途经。
Based on the hot issue of the Arctic contestation, this paper first discusses the rights that China enjoyed in the Arctic seas under the existing international legal system and mechanism which includes the United Nations Convention on the Law of the Sea, the Svalbard Treaty and other relevant conventions of International Maritime Organization. Then it analyses from both the political and legal perspective the reasons why China should get actively involved in the Arctic affairs to obtain more ocean rights.
