摘要
随着专利池在产业实践与企业竞争中发挥越来越重要的作用,其对技术创新的影响也日益凸显。但现有研究关于专利池对技术创新影响的成果较少且呈现对立观点。在对专利池的概念、发展历程、特点及其对企业技术创新影响的国内外相关文献进行系统综述的基础上,从创新激励、制度约束、交易费用、技术传播和知识溢出等四个方面阐述了专利池对技术创新的积极影响;同时也从反垄断和专利池自身非效率因素两方面分析了专利池的发展对技术创新可能产生的消极影响。
As patent pool plays a more and more important role in industrial practice,the impact it brings on technological innovation is becoming increasingly prominent.Existing research on the impact of patent pool on technological innovation is relatively rare and presenting opposing view s.On the basis of a brief introduction to the conception of patent pool,its history and characteristics,this paper conducted a summarization and theoretical review on existing literature about influence of patent pool on technological innovation.Its positive effect w as discussed in four aspects： stimulating innovation,promoting utilization of patent,saving transaction cost,facilitating know ledge interchange and technology diffusion.We explored its potential negative influence as w ell： monopoly it may bring and its intrinsic inefficient factors.
