摘要
专利交叉许可协定,作为一种企业行为,在知识经济时代,一方面通过清除技术研发过程中的专利障碍、便利企业规避反竞争性调查和降低专利交易成本并避免专利侵权诉讼等作用,而被企业广泛采用;另一方面,通过激励企业加大R&D投入而促进了技术进步,并增进了社会福利。同时,专利许可作为一把双刃剑,也将通过便利企业串谋、降低企业R&D投入的积极性和专利权滥用等渠道,阻碍了技术进步,并进而损害了社会福利。本文最后结合中国实际给出了简要的结论性评述。
As an enterprise＇ s behavior in the years of knowledge economy, the patent cross-licensing agreement is widely accepted by the enterprise on the one side as it may clear the patent obstacle in R＆D process, escape from investigation on anti-competition, reduce the transaction cost of patent and avoid patent infringement dispute, it may, on the other side, promote technical progress and increase social welfare by encouraging the enterprise to invest in R＆D. Meanwhile, as a two-blade sword, the patent cross-licensing agreement may block technical progress and harm social welfare as it may be convenient for enterprises to collude with each other, dampen their enthusiasm to invest in R＆D and abuse patent right. The paper finally gives some brief and conclusive comments in combination with the actual conditions in China.
