摘要
从类型学出发,刑事诉讼立法表现为对立的两种理想类型:一是价值导向性立法模式;二是技术性立法模式。《刑事诉讼法第二修正案》的修法活动实为一种类价值导向性的立法。其特征为:政策与法理短路相接导致法律内部的紧张与对立,进而造成致力于精确性和明晰性的立法技术在立法中的有限应用,乃至反向利用。最终致使《第二修正案》在形式、结构与内容上均存在明显的技术缺陷。欲对其予以弥补和完善,须从价值导向性立法转向技术性立法。
Based on Weber＇ s typology , the criminal suit legislation is presented as two opposite ideal types. The one is the model of value oriented legislation, and the other is the model of technological legisla tion. The legislative activity of The Second Amendment is actually similar to the model of value oriented leg islation. The Second Amendment exists a lot of obvious technical defects in terms of form, structure and con tent. In order to remedy and perfect it pertinently, we should transform from value - oriented legislation to technological legislation.
