摘要
WTO《反倾销协定》规定日落复审制度的初衷在于限制反倾销措施无休止的适用,从而避免反倾销成为贸易限制措施的利器。但由于国际经济形势的持续低迷,越来越多的国家在反倾销大战中通过日落复审程序延长了反倾销税的征收期限,从而达到保护自身利益的目的。作为世界经济重要实体之一的中国,近年来在遭遇大量反倾销调查的同时,也越来越多地被提起反倾销日落复审调查,由此带来的负面影响日渐凸显,因此有必要在借鉴新一轮多哈回合谈判中关于日落复审修改建议的前提下完善我国该项制度的相关规定,以达到善用规则,保护自身经济利益、维护多边自由贸易体制运行的效果。
The original purpose of the Sunset Review System in WTO ＂Anti-Dumping A- greement＂ is to stop the repetitive application of the anti-dumping policies. More and more countries extend the collection period of anti-dumping tax with sunset review procedure to pro- tect their interest. China is facing more and more anti-dumping investigation and anti-dumping sunset review investigation. The negative effect is more obvious. So it is necessary to improve the related laws in China with reference of the Correction of the Sunset Review in Doha Round, so as to make good of the rules and protect our economic interest.
