摘要
检察案例指导制度作为司法改革的一项尝试性内容,历经多年探索,具备了一定实践基础。但在理论和实践层面均存在不同意见,如对制度具体内涵、指导性案例的效力、适用范围、选编程序等基础问题,尚未形成统一认识。文章通过对检察案例指导制度基本理论的梳理,突出检察案例指导制度自身价值、特性,结合各级检察机关职能特点,探讨检察案例制度的具体构建及相关机制保障,旨在建立符合国情,富有创新性、实用性的检察案例指导制度。
After years of exploration, the prosecution cases＇ guidance system as judicial reform in an attempt, possesses some practical basis. However, in both theory and practical levels there are different views. Fundamental problems will not reach a consistent understanding, such as the specific meaning of the system, the effectiveness of the guiding cases, the scope of operation, selected procedures. Through basic theory of the prosecution cases＇ guid- ance system, the article stresses value and features of the prosecution cases＇ guidance system, combined with func- tional characteristics of the procuratorial organ at all levels to explore the specific build of the prosecution case sys- tem and related safeguard mechanisms, aiming to establish a national context, innovative and practicality of the prosecution cases＇ guidance system.
