摘要
我国虽然立法规定了查明外国法的方式和责任,但是进一步细化的规定仍然缺失。外国法的查明规定的落实面临诸多困难。因此超脱外国法的事实和法律之争,建立外国法查明中专家意见制度势在必行。专家意见制度包括专家资格问题、法院对于专家意见的审查与排除、外国法专家意见的责任制度等。本文结合外国的相关制度和我国的具体审判情况,对相关制度的构建提出建议。
Ahhough legislation has confirmed the legal way and responsibility in the proof of foreign law, the further refinement of regulations is still missing. The implementation of the proof of foreign law regulations still face many difficulties, so set aside the law dispute of facts or the law about the foreign law and establish expert opinion regulation is the trend of the times. Expert opinion system includes expert qualification, court＇s review and elimination, and expert liability system, etc. Based on the comparison between China and foreign specific trial practice, this article will propose some legislative suggestions.
