摘要
低碳壁垒在后金融危机时代相继登上历史舞台,尽管美国等发达国家意欲借低碳壁垒保护国内生产者的竞争力,有"借应对气候恶化之名,行贸易保护之实"的嫌疑,但从GATT第20条出发,碳关税、碳标签并不被WTO所绝对禁止,只要其实施方式是合理的、非歧视性的。因此我国对待低碳壁垒必须顺势而为,区分合法的低碳壁垒和非法的低碳壁垒采取不同的策略,同时为防止"碳泄漏",我国应建立自己的低碳壁垒,阻碍高能耗、高污染的产品和产业进入我国。
Low carbon barriers in the financial crisis age have boarded the stage of history. Although the United States and other developed countries utilize low carbon barriers to protect the competitiveness of domestic produc- ers, in the name of climate deterioration, carbon tariffs and carbon label are not be absolutely prohibited by WTO according to GATr article 20, as long as the implement method is reasonable and non - discriminatory, So our country must distinguish legal low carbon barriers and illegal low carbon barriers, and then adopt different tactics. To prevent carbon leakage, China should establish our own low carbon barriers and obstacles energy - intensive, polluting products and industries to our country.
