摘要
民生保障是当今中国的重要议题,国家对民生保障在尊重与给付义务方面已给予了充分关注,而对保护义务的履行则稍显不足。基于保护义务在民生保障中的重要地位,需要强化保护义务在民生保障过程中的履行。由于国家理性的制约,保护义务在履行过程中应明确其范围与程度。在这个基础上,遵循保护义务的内在结构,从预防、排除及救济三个层次对民生保障予以实现,是落实民生保障过程中国家保护义务的应对之策。
People＇s livelihood security is an important issue in China today. Though the government has paid more attention to the issue of people＇s livelihood security and the duty to afford, the fulfillment of the duty to protect is slightly less committed. Considering the important role the duty to protect plays in people＇s livelihood security, the fulfillment should be strengthened in the process. Due to the restrictions of the reason of state, the duty to protect should be restricted by a certain limit in the process. And based on this, following the internal structure of the duty to protect, achieving the aim by prevention, exclusion and relief is the proper strategy in the process of committing the state protection obligations of people＇ s livelihood security.
