摘要
从社会现实出发,寻找正确的司法哲学指导司法活动,积极回应时代的司法需求,是政法人的时代司法使命。作为中美司法能动的主要倡导者,沃伦和王胜俊都主张司法应积极回应政治和变革时代的民众权利需求,高度关注弱势群体的权利保障,关注社会实质正义,注重司法结果衡平。但由于生活的政治、意识形态、文化和社会历史背景等巨大差异,二人对于能动司法的理解当然也不完全相同。
From social reality, to find the right judicial philosophy guiding the judicial activities of the positive response to the judicial needs of the times, is the political and legal mission of the era of justice. As a leading proponent of Sino-US judicial activism, Warren and Wang Shengjun advocate that justice should actively respond to the needs of the public rights in the times of political changes , highly concerned about the protection of the rights of vul- nerable groups, concerned about the substance of social justice, focusing on equitable judicial results. However, due to great differences of political, ideological, cultural and social historical background of life, they dan＇ t understand the dynamic of justice exactly the same. When we stressed the dynamic administration of justice, China should focus on combining the law of development of judicial career at the same time.
