摘要
中小企业合同法律风险是企业法律风险中较常见的一种风险,中小企业在合同订立、合同履行、合同纠纷发生时均存在各种法律风险。风险防范意识缺乏、风险控制重视程度不够、控制措施单一、内部管理机制不健全是中小企业合同法律风险频发的重要原因。中小企业需要通过提高合同法律风险防范意识、优化企业合同业务流程、完善风险管理制度、建立合同法律风险预警机制以构建中小企业合同法律风险防范机制。
The contract legal risk of small and medium - sized enterprise is one of common risk in enterprise legal risk, and small and medium - sized enterprises in contract, contract performance and contract disputes are various legal risk. Small and medium - sized enterprises are lack of the awareness of preventing risks, risk control is seriously not enough, control measures is single and unsound internal governance mechanism is the main reason of contract legal risk happened fre- quently. Small and medium - sized enterprises need to improve the prevention awareness of contract legal risk, and opti- mize the business processes of enterprise contract, improve the risk management system, establish mechanism of early - warning of contract law risk in the construction of legal risk prevention mechanism of small and medium - sized enter- prise.
