摘要
中美两国的战略环评立法存在较大差异,我国应当部分借鉴美国的相关规定对战略环评立法进行完善:在战略环评对象方面,应当通过名录的方式进一步明确需评价的规划的具体范围,并考虑将政策纳入评价范围;在战略环评主体方面,应扩大行政监督范围,大力发展公众监督,并增加相关部门对战略环评的支持义务;在战略环评程序方面,应将战略环评程序有机融入战略决策程序之中,根据环境影响大小确定评价范围,并增加有关替代方案的规定。
The SEA legislation has many differences between China and USA, and the latter can afford some suggestions for the perfection of our SEA legislation.With respect to the objects of SEA,it is essential to make the scope of plans clearer by indexes and include policies as the object of SEA. Regarding the subjects of SEA, we should extend the authority of administrative supervisor, fully develop public supervision and emphasize the supporting duties of relevant departments. For the procedure of SEA, we should make the SEA procedure as one part of the whole procedure of the strategic decision, decide the scope of assessment by the potential environmental impact and add rules on the alternatives.
