摘要
在国内学术界,有学者试图依据黑格尔的法哲学理论,提出"德—法整合"命题,为在现实社会中实施依法治国与以德治国相结合的治国方略,提供理论上的根据和支持。在黑格尔法哲学理论中,是法律统摄并涵盖道德和伦理,而不存在一个道德与法律之间"互动整合"的"德—法整合"关系。因此,从黑格尔的法哲学理论中寻找法治与德治相结合的治国方略的思想资源,只能是对黑格尔法哲学理论的误解和曲解。
In domestic academic field,there is some one is trying to propose the proposition of morality-law integration according to Hegel’s Philosophy of Right in order to provide the theoretical support for governing the country by law and by morality.In Hegel’s Philosophy of Right,it is the law that consists morality and ethics rather than the moral-law integration.Thus,it is a misunderstanding of Hegel’s Philosophy of Right to seek the governing strategy of the combination of ruling by law and by morality.
