摘要
在我国现行法律体系下,营利性民办学校面临着合法性困境。根据"营利"及相关概念的法学阐释,营利性民办学校是指可向出资者分配办学结余的民办学校。营利性民办学校合法性困境的产生,与教育不得营利的传统观念有关。基于当前大部分民办学校是投资办学的基本现实,营利性民办学校的存在具有正当性。化解营利性民办学校的合法性困境,必须完善现有法律制度。
In our current legal system, for-profit non-state schools face the legality dilemma. According to the legal interpretation of ＂for-profit＂ and related concepts, the for-profit non-state schools mean non-state schools which can distribute net earnings to their investors. The legality dilemma owes partly to the traditional belief that education shall not be for-profit. Based on the fundamental reality that most non-state schools are set up by investors, for-profit non-state schools have legitimacy. To dissolve the legality dilemma, current legal system should be perfected.
