摘要
近年频发的各类环境污染事件充分暴露出,我国环境信息公开存在不主动、不及时、不完整和不准确等问题。造成这种状况的原因是:环境信息公开的立法位阶偏低,相关规定缺乏科学性和可操作性;政府对企业环境信息公开的监管缺乏力度;政府环境信息公开缺少有效的救济手段。完善我国环境信息公开制度,在理念上应强调环境信息公开的公众导向;在制度上应细化环境信息公开的内容与方式,完善环境信息公开的救济制度;同时,还应建立环境信息公开过程中政府与企业、政府与NGO的协同机制。
There exist passive,untimely,incomplete and inaccurate problems for environmental information disclosure in sudden environmental pollution incident happened frequently in recent years.The reasons for this situation are as follows： low legislation level in environmental information disclosure;unscientific and infeasible relevant regulations;lack of intensity in the government supervision of corporation environmental information disclosure;lack of effective remedy in the government environmental information disclosure.Hence we should put emphasis on the public orientation in the disclosure of environmental information conceptually;refine the content and methods in environmental information disclosure institutionally;improve relief system of environmental information system;meanwhile,we should establish the collaboration mechanism between the government and corporation,the government and the NGO in the environmental information disclosure process.
