摘要
信访是极具中国特色的社会现象,信访行为及其相关制度的存在和发展有深刻的社会历史背景。在经历社会转型的过程,建设社会主义法治国家的背景下,信访行为呈现出新的特点,与此相关的信访制度也面临着由传统到现代的理性选择。因此,在中国特色社会主义法律体系已经初步形成的框架内,信访制度的设计与安排应当摆脱传统政治思维的桎梏,逐渐实现信访制度的去政治化,信访机构的多元设置要通过更为规范化和制度化的程序,充分实现其化解社会矛盾的功能。此外对公民所享有的信访权利的定位也要实事求是,从现有的宪法权利和法律权利体系的实际状况去考虑。通过审慎的思考使信访制度能够更好地为社会稳定及发展提供一种有效的保证方式。
Petition is a social phenomenon with Chinese characteristic.The existence and development of complaint letters and visits and some related systems have profound social and historical background.Petition present new features,where China is undergoing a social transformation and is in the process of building a socialist country rule by law.The related Petition system also needs to make some rational choices from traditional to modern.Therefore,with the socialist legal system with Chinese characteristics basically formed,the arrangement of the Petition system should get rid of the shackles of the traditional political thinking.In order to fully realize its functions to resolve social conflicts,the Petition system would gradually realizing non-politicization,and the multiple settings of Petition agency should be more standardized and institutionalized.When thinking about the positioning of the Petition,we should be realistic,and take the actual situation of the fundamental rights and the legal rights into consideration.Petition system could provide an effective way for social stability and development in the transition period,if we put careful thought into it.
