摘要
入世以来,我国农业国内支持水平不断提高,基本形成了以"绿箱"为主,"黄箱"为辅,"蓝箱"备而不用的国内支持结构。但当前我国国内支持措施主要散见于政策文件和部门规章中,《农业法》及其相关法律对具体国内支持制度基本没有涉及,部分支持领域甚至存在立法空白,导致法律体系严重滞后于农业实践的发展。因此,当前迫切需要建立一套科学、长效、稳定的农业国内支持法律制度体系,对促使农业政策的制度化、法律化,增强国内支持制度的刚性规制,促进农业的可持续发展具有重要现实意义。
Since the accession to the WTO, the level of agricultural domestic support has increased. In the framework of domestic support,the＂green box＂ is the main body,＂yellow box＂ is subsidiary to the ＂green box＂,and ＂blue box＂ is taken as the backup. At present,the measures of support only can be found in poliay documents or rules,which means they have not been involved into the legislation. Therefore,it is looking forward to establishing a set of scientific, longterm and stable agricultural domestic legal system which is very important to promote the sustainable development of agriculture.
