摘要
将要制定的我国民法典 ,必须从社会主义市场经济的需求出发 ,总结民法通则的立法经验 ,理顺民法基本原则的逻辑关系 ,重新构筑民法的基本原则体系。本文认为 :我国民法的基本原则应由平等原则、自愿原则、尊重社会公共道德原则。
To enact a civil code in China,the needs of the socialist market economy must be taken as the starting point,the legislative experience in the making the General Principles of Civil Law should be summarized,the fundamental principles of civil law be coordinated logically and the system of the fundamental principles of civil law be reconstructed.The author of this article holds that the fundamental principles of civil law of our country should comprise of such principles as equality,autonomy,public policy and bona fide as well as the prevention of the abuse of rights.
