摘要
REITs是一种以发行收益凭证的方式汇集特定多数投资者的资金,由专门投资机构进行房地产投资经营管理,并将投资综合收益按比例分配给投资者的一种信托基金。虽然REITs在国外取得巨大成功,但其赖以生存的法律生态在当前的中国并不完善。无论多么好的东西在一国扎根都需要与之配套的相关制度,否则只能是"橘生淮北则为枳"。法学界重视对REITs的研究,尤其是其配套制度的研究,将对中国版真正意义上与国际接轨的REITs的顺利诞生起到助推的作用。
REITs is a kind of way to collect most of investors＇money through releasing income docnments and is managed by special investment agency, and is a kind of trust fund to distribute fund in proportion of comprehen- sive income. The law circle pays much attention to the research of REITs, especially the research of supporting sys- tem, and it will be a smooth booster to meet international standards.
