摘要
古今中外,刑法的谦抑思想都闪烁着魅力,现代文明的发展要求现代刑法更应体现谦抑性的价值。研究刑法谦抑性的哲学依据,有利于现代法治的发展,也是限制权力滥用,以人为本的体现。
At all times and in all countries, the restraining criminal law ideas are charming. The development of modem civilization should reflect the modesty of criminal law value. Researching on the philosophical foundation of the limiting criminal law, is not only beneficial to the development of the modem law, but limiting the abuse of power and people -oriented.
