摘要
深圳市小产权房因原土地类型不同而呈现不同的形式,包括在宅基地、集体建设用地、耕地、审批批准后建房、合作建房等类型;由于自2004年开始深圳土地实行国有化,所有集体土地所有权转变为国有土地所有权,从而使在土地所有权基础上设立的用益物权也发生变动,从而导致土地之上的小产权房也各有特性。深圳在清理小产权房过程中,应当充分考虑不同的土地使用权和房屋判断小产权房的出路。
The informal house property in Shenzhen has different forms as on which the land property has different types, such as homestead, collective con- struction land. arable land, buildings after approval, cooperative housing and so on. Since Shenzhen began the process of nationalization, all of the collective con- struction land became state-owned land. It causes the usufruct which is set up on the base of land ownership has changed. It also makes the informal house property with different characteristics. In the process of clearing up the informal house property, Shenzhen should take full account of different use rights of land and houses and determine outlet of informalhouse property.
